Hankyungs’ Lawyer’s Latest Statement Regarding the Lawsuit

All the following statements come out from the truth that I’ve witnessed around Han Geng these years,and I promise I’ll be responsible for all my words.
I.Masks
In the early time of SuperJunior’s debut(around year-end of 2005 and beginning of 2006),Han had to perform with a mask on his face and could only appear in few TV station because of some kinds of reasons. This has shown an obvious discrimination and insult on Han,which also made severe psychology shadow on him.There are problems in relatived laws of South Korea,and also in management of SM Co,.Ltd. Compared with the fact that Han haven’t to wear masks some time later we could draw the conclusion that SM Co,.Ltd hadn’t handle the issue suitably and ignored Han’s interest and rights.
II.Discriminatory
The concert of SuperJunior Show on 22th Nov, 2008 in ShangHai,Han’s family member were arranged in the far corner wittingly or unwittingly,while the Korean members’ family is arranged in the centre of auditorium.The arrangement was changed until Han’s family were seated and found out the discriminatory and end up with seated in centre unditorium after contending with SM Co,.Ltd.
III.Discriminatory on Financial Proportion
Korean members in SuperJunior share all the expenses in China(including private living goods) with Company and other members.While Han Geng could only pay his personal fees by himself unfairly.
IV.Discriminatory Chinese Actors in Daily Life
Every Korean members could go back home in their free time in Korea,while Han was asked to stay in apartment with other members in China.The company reluctantly accepted the asking of tenement an apartment near the site of company through consults.
V.Insecurity of Reward Distributee
SM Co,.Ltd settle Han’s accounts biannually with only general ledger but not detailed accounts.The unclear accounts deprived Han’s right of informed and speak that Han couldn’t get enough security on his originally poor payment.SM never offered detailed receipts neither for scripts nor copy,and refused to provide under several times of demanding.
SM offered only Korean Won to Han Geng which needs two times of agiotage to turn to Chinese Yuan.The lost between the agiotage brings up more loss to the unfair reward.Although SM doesn’t have formal subsidiary company,they still have respectable RMB cash flow.Han Geng has suggested changing the settlement method in order to minimise losses but all be refused without a resonable explanation.SM ignored Han’s benefit and never explained or resolved this issue.
VI. SM Co,.Ltd. often procrastinate even refuse many developement opportunities of Han Geng which infrigement his rights l lot.
Here are the evidences:
1. In the year of 2009,Procter&Gamble Company decided to employ a man actor to endorse for OLAY products for the first time.SM Co,.Ltd. refused the cooperation for many reasons while Han Geng knew nothing about the whole thing through an informed staff until end of 2009.
2. June 2009,the Taiwan actress Yichen Lin called for a hero in her Music Vedio.Han is the designated hero by Lin’s company but SM Co,.Ltd refused the request out of boosting Li Donghae and Choi Siwon,two Korean actors.Lin’s company finally determined the two Korean actors play roles in Lin’s MV which limited Han Geng’s developement.
3. At the end of 2008, the movie Mulan started to choose an actor for the Men’s Second Role. The producer favorited Han Geng and communicated with SM Co,.Ltd. for many times,but SM put all the invitations off.This not only limited Han’s personal development,but is also contrary to thier promises on giving acting opportunities to Han.
Regarding all the facts above,from my viewpoint,Firstly,SM Co,.Ltd. offered little opportunities to Han Geng(2 single Endorsement,1 TV series from debut)compared with his popularity and importance.What’s more,SM created many resistances when servicers discuss cooperations with Han Geng,which is discrimination in fact.
Secondly,SM cracked down Han’s development when facing many good chances but not support him,for fear of the form of Han’s personnal developing room and resources.This violates Han’s legitimate interests and restrict his personnal development terribly.
Finally,freedom on economic activity is the basic human rights which nobody could attempt or indeed deprive or restrict.The series action of SM Co,.Ltd tend to and had indeed deepened Han’s attachment to the Company and restricted Han’s freedom of economic activities.The action is severe infringement on Han Geng’s individual fundamental rights.
VII. SM ill-mannerd Han’s potential customers and friends,and had had framed person introduce businesses to Han Geng.
Take me myself for example.Around March or April in 2009,I introduced a performing business called Night of Changbai to Han Geng.SM Co,.Ltd quoted a higher price to me(take ￥350,000 yuan for example)and quoted a lower price to the sponsor ( ￥300,000 yuan for example),which made the sponsor mistake me for accepting rebates and hurted my own fame.I called Mr.Kim the broker of SM to interrogate the reason to do so,only get a reply like “we won’t do that next time” without a solution.Many show sponsors,media and cooperators feels strongly dislike on the attitudes and the ways the SM staffs have.

idk..is this really credible? Apart from the weird grammar, there are parts that I can barely understand.
And seeing that this is from Geng’s Baidu Bar, it might be fan written.
The article seems to be deleted from the Baidu Bar too…
I really don’t want Geng to leave too, but some things sound a little too strange to be coming from a lawyer who’s officially representing Hangeng.

I think its easy & selfish at the same time for us to tell him not to leave. Do we truly understand what the above means??
Put yourself in the shoes of Han Geng. To be away from your country, in a foreign country with minimal knowledge on their language and throw all the discrimination and unfair treatment put to him. It totally violated all of his rights.
It’s easy for us to want to have the perfect picture. It’s easy for us to say that all SM needs to do is to satisfy all of Han Geng’s needs.
But has it occured to you that if they do settle this amicably, and Han Geng goes back to SJ, SM might just repeats its history?
Who knows SM might secretly impede Han Geng’s future again in future?
Can anyone guarantee that?
As much as I wished Han Geng to be part of SJ, I don’t want him to go back to SM either. He has suffered enough and I wish the better for him. If SM was a good company, it wouldn’t have attracted 2 legal lawsuit in a row from 2 of its most successful artist groups.
The cold harsh truth says it all – SM does not treat his artist well (look at DBSK), let alone Han Geng, who isn’t a Korean.
If Han Geng will be happier by leaving SJ, I will support him till the end.

Stop acting like you’re the only one who thinks for hangeng.
Who doesn’t know what tyrants SM are.
Who doesn’t know that he is not happy in SM.
They are just expressing their wish that suju will always be the same.
BUT they never demanded that Hankyung MUST stay.
Besides, what can the fans do? They can only hope.
But when the time comes for Hankyung to make the ultimate decision. I am sure people will respect his decision.

I also agree, totally. All I want is for SJ to be 13 (+2) again. By saying that we wish for SJ to be together doesn’t mean we don’t ‘understand’ the situation Hangeng is in. It’s just that SJ’s always been 13 and fans hope that it will stay that way, forever. dotdotger, you cannot say that the fans are being selfish because they hope. That flicker of hope is all we have and fans will live by that. No matter what happens, fans will always support Hangeng. It’s just a matter of what’s best for him and if SM’s willing to change (or possibly get sued by even more artists) then by all means he should reconsider. I don’t intend to say that he HAS to stay.
In my ideal world I would want SJ as 13, plus M as 15.
Managed by themselves and having the time of their lives.
Earning more than Bill Gates or whoever’s the richest man alive ATM.
But reality doesn’t go that way…it never does.
So all I’m saying is that fans have the right to hope.
And Hangeng has the right to decide for himself.

Do you speak for every single fan out there? How do you know that they NEVER demanded him to stay? I know ELFs are one of the best fan clubs out there whom will do anything for the best interest of SJ. On the humanity side, can you guarantee that every single ELF can be as objective as what you have mentioned in your post? If every fan can be as objective, Henry & Zhou Mi wouldn’t have to suffer from part of their hate-fans, even till now.
I am not depriving any of us for any hopes or wishes for him to come back. My posts wasn’t meant for everyone who posted here either. I used the word ‘us’, that means me included. I did not direct that comment to any specifics. I don’t speak for him. That was just a reminder to some of the minority who insists on him going back to SJ no matter what.
I know most of us hope for him to go back, but will too, support him if he ever leaves. But like I said, ‘most of us’.
I admit that my comment might have sounded harsh, and for that I am sorry. But as I said, that comment was only going to the minority who aren’t going to accept his decision. If you don’t think that way, I don’t think it should have affected you because it wasn’t directed to you. That’s all.
I am not going to further defend myself because I think that, I too, have a right to speak up for what I feel. I wasn’t representing anyone, and it wasn’t directed to anyone too. As much as I like to believe ELFs are 101% for their SJs, we never know if there will be a minority group out there who cannot be as objective. That comment was just going to them.

There’s no denying the fact that SME’s not the greatest buisiness out there. We all know that SJ will NEVER be the same if Geng leaves, but I think that as ever.lasting.friends we should maintain that, and support his decisions. I totally agree with you guys that we want whats best for him, but that we would also prefer for him to stay in SJ+M. Deep down we know its gonna kill us if he leaves, but if whats best for him is to leave, then I hope he can life his life to the fullest. For a fact, he’ll know that I am still going to be one of his fans no matter what he ends up doing(and I’m not saying that you guys will stop supporting him. :] )
I just hope SME can straighten their poo-poo out soon, I can’t bear another lawsuit. It’ll just prove that SME is NOT worth it if things like this keep happening!

Thanks for sharing.
Actually I’ve read many such articles before in Hangeng baidu and other Hangeng’s fansites, but surprisingly none in Super Junior sites. That’s mostly bcos they don’t want other fans to know abt it since they want Hangeng to stay. In actual fact, most dedicated loyal Chinese fans of Hangeng knew long ago abt SME mistreating Hangeng and this explains why they’re very supportive of Hangeng leaving SJ.
I’m not saying I want Hangeng to leave, but it’s just that I’m really frustrated when I see fans judging him without finding out the truth, saying that he’s very selfish and all. He’s not. In fact, he’s one of the most selfless & kind-hearted artiste I’ve ever seen.
Please don’t judge Hangeng without finding out the truth first. He has suffered enough. He’s just trying to stand up for himself. I hope everyone can understand why he feels the need to sue SME.

I beg to differ
Even tho our ideal Suju is 13(+2), it does not mean that 13-1=0
are you to say that if hangeng leaves, you would not support suju anymore?
Super Junior is a group of funny, down to earth boys which we love,
but even with a missing member, the other 12 still deserve to be supported by E.L.F..
Be it 13, 13-1,12+1,15+1 whichever equation you gonna have, suju will still be suju and E.L.F should still be E.L.F

i hear all these accounts from his representatives and such, and i bet they’re true facts. But i also want to know how he TRULY feels, coming from his OWN words with no interruptions and such. I know he;s had a couple interviews already, but still.
Because for me I don’t konw how to support who or what… to support Hangeng even if he leaves super junior or to support SJ as 13.
I also want to know how super junior feels about this, and how hangeng himself feels as well. I don’t know too much in detail, but I know he wants out of SM ent, which is treating him like trash, but that means he will quit SJ as well? or does he still want to be with SJ through a different company, like how dbsk wants to try and do?
I’m just so darn confused and sad, and I just hope everything turns out for the best for everyone.

Gosh, I knew SME did treat Hangeng unfair, but so many facts about it, I couldn’t even imagine, what’s with the discrimination? Omg.. Shame on you SM.. So that means Hangeng actually would have been starred in Ariel Lin’s MV, instead of Donghae and Siwon. I can’t understand why they just didn’t refuse the opportunity to star in it, because they might have known about that SMe pulls out Koreans first rather than foreigners. And Olay? SMe has gone crazy, Hangeng donated at least two times a big sum of money to major charities, is one of the sweetest persons on earth and yet SMe don’t see through this and rather be greedy ‘n let him pay for his own fees. That’s just sickening

i doubt donghae or siwon knows about it.
SM was never transparent with their dealings with their artistes.
The point of SM is to earn more money for the bosses NOT to take care of the welfare of their artistes.
So why would they give a flying sh*t about how much Hankyung donates to charity.

I am so mad at SME that I had to write something… It’s bad enough that Asians get discriminated by others, but Asians discriminate against Asians? I used to know nothing of the Korean culture except for stuff like they had good dramas. But because of Hangeng, I started to be more interested in the Korean culture, their people, their language and their music. I’m sure a lot of people are like me. They should thank Hangeng for that. But instead, they mistreat and abuse him. Yes, its true that SME gave him the start, but it’s up to Hangeng and his own hard work, kind personality, talent and determination to be where he is today.

thanks for writing this, but seriously that’s such bias and discrimination. just because he’s CHINESE, he has to pay his own bills, is not allowed to visit his parents, is denied more opportunities in CFs and MVs and etc etc. SM may have given Hangeng’s big break, but they can’t toss him around like a little toy. they have to fairly treat each member the same. they don’t realize what a huge impact it would be on SJ if he left. like look at the comments now. it was posted TODAY and has 35 comments including mine. so many fans would boycott. i don’t blame Hangeng for wanting to leave. i actually think he should for being treated so terribly. but in my selfishness, i hope SM realizes their wrongs and fixes it so we can all have our Hangeng back <3

It’ll take a miracle to make them realize their mistakes and fix their wrongdoings.
It’ll be wise for Hangeng to leave SM but I bet he’s in a dilemma right now. To listen to his fans yelping “13/15!” or to go his own path.

i can’t believe this…hangeng has been holding in so much!…his problems with sm started right from the start! and yet he stayed with suju all the way until now…i give him so much credit.
what really got me was the Ariel Lin’s MV situation!
it makes me wonder about other things that we don’t know about that involve unfairness for all the other suju members
ugh! when will this case be over and done with!

This account of the lawyer seems to good to be true. Please don’t bash me, I love Hangeng and hope the best for him. Even a company like SM would know better than to treat Hangeng like that. I understand the whole money and endorsements problem, that’s plausible. But the mask thing is outrageous. It was THE LAW at that time for Korean broadcasting channels that foreigners were only allowed on so many channels. That was lifted already, it wasn’t SM’s fault. That whole concert seating was probably a messup, Hangeng has said before he could see his parents in the front crying when he performed on the concert stage. Some endorsement claims seems a bit outlandish on the other hand, they had to discuss it with him, even SM wouldn’t stoop that low. That whole china expenses sounds false, and having to “watch members”? Seriously, they’ve been to foreign countries before and some members know their way around now, obviously SJM.
If you also think, Hangeng joined about 10 years ago, look at the timeline and observe changes that have been made to companies regarding their talents. They learned from their mistakes and that’s why foreign trainees are treated better. Hangeng entered at a time where SM was still a young company.
I don’t know whether that document is legitimate or not, but I hope to know what Hengeng inside, truly feels

@everyone..there’s no point in speculating. It’s not verified, and plus the fact that Geng’s Baidu Bar and TwElfs has since deleted the article.
It’s drawing a lot of negative attention that is not helping the current situation at all, especially when the contents might not be true. I know SME is probably dirty as hell, but we need real facts, not fan-written rumours to make things worse =\

as for me, i want the best for him..if the statement above is true, i think it is better for him to end the contract with sm although he has to leave SJ..he is my most favorite member in SJ.. ever since SJ was debuted i only like him..i can understand everyone feeling if Hanny have to leave SJ, but as an E.L.F. we should always supporting him and accept whatever his decision is..trust me, he want to make us ‘fans’ happy too..let us just pray that things will end up right for him..and i believe we E.L.F. will always love him..
